Low Time FO Grievance to be heard

    Mr. XXXXXXXX,

You previously submitted a contract compliance form indicating that you are a potential witness in the above matter which is set for arbitration beginning on July 30, 2013, in DFW. In order to prove the nature and extent of the contract violation, several pilots will need to testify to specific factual examples of the violation.

Please contact Senior Labor Relations Counsel Wayne Klocke at 817-685-7474, extension 5336, at your earliest convenience to discuss the seniority violations that you personally observed in connection with this case.

    Thank you.

    Best regards,
    Emily

I just got off the phone with counsel. So far I know of one other pilot besides myself who will be testifying at a deposition scheduled for July 29-31. He is requesting that ALL FO's who have been affected by the contract violation. I was the only one from MIA to contact him.

    This includes FO line holders.
    This includes FO reserves.
This also includes those FO's who were awarded Low Time lines!

If you are a FO, you have been affected!

If you have N6D's from the beginning, send them.
If you have N3D's, send them
If you have pay and activity sheets (You Do!), send them!

The more information the better as the company is balking at information requests.

If you were a Low Time FO, expect an email asking your assistance. You are not being sought after negatively; your assistance could be a key piece of evidence. Do not fear retribution. It wasn't your fault you were forced to accept a questionable schedule without guidance. (I know some were told to fly it even though they disagreed with it and attempted to refuse the assignments. Those FO's are highly sought after).

They are also seeking Executive pilots who have witnessed or can attest to the contract violation on that side of the house. No one has come forth so far.

    S

Edit: They are pulling me off my reserve schedule (not sure if with or without pay), flight to DFW, and hotel.

Okay, I'm a DFW FO mid seniority on the list here, I'll send every activity sheet I have. Are they just wanting activity sheets? I don't have any N3Ds. I have no doubt I've been affected by this but I'm not sure how to go about and prove it. I guess that's the lawyers job?

DFW FO on RSV, I have all the N6D from march to jun, talked to the counsel on the phone, going to see him next wednesday, i have sent something like 80 greviances. I would have been able to hold a line since dicember if it wasn't for the contract violations..

I'm going down there also to rep ORD fo's. Hopefully we can get something out of this. I had 7 months on comp lines thA should have been hard lines and 2 months of rsv thAt also should have been hard lines.

Next month republic comes to ord and our lines in Chicago show it. Back to rsv for this guy. This place is going down hill fast.

I'd like it to be noted that I believe OT was blocked all year so they could hold OT for low time FOs on RSV. No idea how we can prove this besides my dip in YTD earnings for the year and my claim that due to the companies OT blockage, I was unable to improve my income. I think there should be a payout to all FOs for damages.

    Low Time Pilot Grievance

Late today, we received the Opinion and Award on the Low Time Pilot Grievance that was arbitrated this past summer.

ALPA grieved that the company violated our CBA when they provided additional flying assignments to low-time pilots out of seniority order. In short, ALPA won the grievance. A copy of the AWARD and ORDER can be found on the EGL MEC homepage.

Arbitrator LaRocco sustained the grievance on its merits and ordered ALPA and management to attempt to fashion an appropriate remedy.

We will be meeting with the company to address the remedy as soon as schedules permit.

reading the pdf i am disgusted to see how dishonest the company is and how they attempted to twist the whole situation. all the people that still believe mgmt should read it, maybe it'll open their eyes.

so now alpa has to meet with company and negotiate a remedy and they have one year to do it?

i guess it's going to be a long wait..
